U.S. District Court Judge David Lawson had removed certain Lenawee County defendants from a wrongful death lawsuit filed by Craig Tank and
Jason Jelalian on behalf of Yolanda Flores, for lack of evidence that the defendants had any direct involvement with Flores before her death.
David Robinson's firm handles a lawsuit against these same defendants on behalf of Aaron Borck, and in Robinson's suit, documents and transcripts
from an internal affairs investigation regarding Flores' death were "discovered" which demonstrated apparently perjurous deposition testimony and
apparent willful concealment in the discovery process in the Flores case, by certain Flores defendants - which ultimately had led to their dismissal
from the Flores case.
In February of 2009, Hugh "Buck" Davis and Cynthia Heenan of Constitutional Litigation Associates, P.C., filed a motion to reinstate defendants
and claims in the Flores case, based upon this "newly discovered" evidence.
On March 31, 2009, a month after the motions to reinstate defendants and claims were filed, Judge Lawson reinstated the claims as to the perjurous
defendants; and in a thoughtful, articulate ruling, also determined that as an Officer of the Court, there is a duty to report the matter to the U.S.
Attorney's Office.
